Stamp Act, 1899–Code of Civil Procedure, 1908–Order 13, Rule 8–Prayer for impounding the power of attorney–Rejection of–Courts below returned the findings on the bare reading of the power of attorney and observed that since it is a registered document, therefore, it is properly stamped–Question as to whether same is liable to be stamped as a conveyance in view of State amendment on account of the delivery of possession at the time of its execution was not examined–Question can be decided at the time of final adjudication after the evidence of parties–Impugned orders set aside and matter remitted back to trial Court to decide the objection of the admissibility of document
accordingly.
