Rajasthan Prevention of Mrityu Bhoj Act, 1960–Sec. 3–Cognizance for the offence–Justification–Cognizance for the offence u/s. 3 r/w. 4 can be taken within one year of the alleged incident–Provisions of Sec. 468 Cr.P.C. are not applicable because the Act is special Act and Sec. 10 bars the cognizance after lapse of one year–Further, the revisional Court has set aside the order of taking cognizance against other persons with the view that the edited VCD was taken into consideration by the trial Court–Impugned orders are liable to be set aside.
