Code of Civil Procedure, 1908–Sec. 10–Consolidation of suit–Application for–Dismissal of–One suit for injunction, based on the ground of agreement of sale in favour of petitioners–Other suit for declaration which is based on besides the agreement to sale and also on the basis of claim of adverse possession–Two diagonally pleas has been raised in both suits–Though the parties are similar and the suit property is same, order of consolidation of both suits can not be issued.
