Penal Code, 1860–Secs. 406 & 420–Criminal proceedings–Agreement between the petitioner and complainant as regards to operating the mines–Complainant being dissatisfied with the quality of limestone recovered from the mine, found that he will suffer the loss–Petitioner is also a director in the
firm of the complainant and there is a dispute relating to the agreement–No case is made out for the offence u/s. 420–Further held, no offence u/s. 406 is made out as the petitioner is the owner of mines–Proceedings are liable to be quashed.
