Arms Act, 1959–Sec. 14(1)(b)(ii)–Arms Rules, 2016–Rules 36(4) & 37–Petitioner is a renowned shooter and he sought the arms licence under the sports quota–Rejection of application with the observation that petitioner’s father is in jail because of the rivalry between the Anand Pal Gang and Raju Theth’s Gang, there can be a gang war–While deciding the rights of citizens, the family history of the applicant becomes irrelevant, more particularly when the application is for licence under sports quota–Rules 36 & 37 of Rules of 2016 clearly provides for grant of arms licence to outstanding sports persons subject of course to a condition of furnishing a certificate by Indian National Rifle Association–The petitioner can neither be crushed for his father’s culpability nor can the State tether her with her father’s acts or crimes to continue all through her life, though she had no role to play–Impugned order quashed and set aside and directed to issue the licence.
