Specific Relief Act, 1963–Sec. 12–Limitation Act, 1963–Arts. 54/113–After extension of period for specific performance, the suit property was subjected to the acquisition by the State Govt.–Both the parties requested for deletion of the property from acquisition–Vendee specifically stated that the land in question has been sold in favour of plaintiff and he is in possession–Right of plaintiff to sue accrued when the defendants refused to execute the sale deed–Land acquisition proceedings were quashed at the instance of plaintiff and, thereafter, the notice was served on defendants–Provisions of Art. 113 would be applicable in the instant case.
