Code of Criminal Procedure, 1973–Sec. 169–Applicability of provision–Provision applies when it appears to the concerned officer-in-charge that there is insufficient evidence or a lack of sufficient evidence to justify for forwarding the name of the accused person(s) to the concerned Magistrate, then such accused, if in custody, may be released on execution of a bond, with or without sureties–Further, the Section would operate during the investigation period, and not after the names of accused person(s) have already been forwarded to the concerned Magistrate.
