Code of Criminal Procedure, 1973–Sec. 227/239–Penal Code, 1860–Sec. 448–Prayer of discharge–Dismissal of–Justification–Application was filed in pursuance of the direction issued by this Court–Tenancy agreement was claimed to be executed in the year 2005 and the symbol of Indian National Rupee i.e.j, mentioned in it, was not in existence at the time of agreement–Prima facie the document was forged and fabricated and concerned Court had issued the direction for lodging a criminal case for it–Possession of complainant was not established and the police found that the offence u/ss. 454 & 380 was not made out against the appellants–Case against the appellants for the offence u/s. 448 was based on shaky ground and respondent no. 2 never objected to it nor he took any step–Clear abuse of process of Court–Appellants are entitled to be discharged from the offence.
