Code of Civil Procedure, 1908–Order 39, Rule 7 r/w. Sec. 151–Report of Commissioner–Under challenge–Court below gave the specific directions for inspection of the property in dispute by taking the details of neighbourhood, condition and measurement of the rooms and walls and also to take the photographs and measurements of the plot in dispute from all sides based upon with the actual position–Commissioner was restrained from making any comment in regard to the possession of the property in dispute–Further, stipulation that if it is made, the same shall not be read–No prejudice was caused to petitioner–Held, no interference is warranted.
