Code of Civil Procedure, 1908–Sec. 151–Scope–By subsequent event if the original proceeding has become infructuous, it is the duty of the Court to take such action as is necessary in the interest of justice which includes disposing of infrutuous litigation and further it is open to the parties concerned to make an application u/s. 151 CPC to bring the notice of the Court the facts and circumstances which have made the pending litigation infructuous.
