Juvenile Justice (Care & Protection of Children Act, 2000–Penal Code, 1860–Secs. 363, 342, 366-A & 376–While conducting the inquiry, concerned Presiding Officer of Juvenile Board acted in perfunctory fashion–Proper quorum was not completed–Held, appellate Court rightly reversed the judgment–However, direction of remand of case would not be proper because if a denovo inquiry is held, the victim would have to be recalled for giving evidence and such action can probably pre-judically affect and traumatize her.
