Code of Criminal Procedure, 1973–Sec. 125–Maintenance–Entitlement–Though the petitioner could not able to establish that the respondent- wife performed re-marriage but he was abled to prove that she gave birth to the baby out of her relations with R–Witness of Nursing Home appeared in evidence and established this fact–Respondent-wife was not present in the Court on the relevant day–Other witnesses also appeared and categorically stated that the respondent was living with R–Held, Trial Court rightly rejected the application for maintenance and Revisional Court was not justified in reversing the order of Trial Court.
