Juvenile Justice (Care and Protection of Children) Rules, 2001–Rule 12–Determination of age–School register showing the accused was below 18 years whereas the medical report showing that the accused was aged of 19 years–Trial judge declined to deem the accused as a juvenile because the parents of juvenile could not give the date of birth of their other children–No conclusive proof that the date of birth mentioned in school register was right–Held, trial Court was quite right in believing the medical report–However, looking to the fact that the petitioner’s age was on the border line, it will be better to treat him as a juvenile.
