Evidence Act, 1872–Sec. 73–Comparison of disputed and admitted signatures on the arrest memo, seizure memo, and recovery memo–Prosecution failed to prove the fact of admitted signatures on arrest memo and seizure memo–No one appeared to say that the signatures were made in his presence or he was conversant with the handwriting of accused–Further, the attesting witness stated that the signatures of accused were obtained on plain paper–Trial Court also had not put the signatures u/s. 313–Held, findings given in regard to signatures cannot be sustained.
