Criminal Trial–Last Seen–Evidence of–Reliability–Deceased was found lying dead in his house–There is not even an iota of evidence suggesting that it was the appellant who lastly went inside the house of the deceased immediately before his death–Witness PW 9 stated that the appellant was wandering outside the house of deceased and not that he saw the appellant with the axe in his hand–Houses of appellant and deceased were almost in front of each other–Trial Court relied on the circumstance of last seen on irrelevant consideration.
