Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Rejection of application–Justification–Appellant-plaintiff produced many proofs including adhar card, gas connection electricity bills and some documents pertaining to survey to prove his possession–Trial Court dealt these proofs in cursory manner and recorded the findings that there is no prima facie case in his favour–No findings over other two elements necessary for grant of injunction vis. balance of convenience and irreparable loss–Impugned order set aside and matter remanded back for deciding the application afresh.
