Penal Code, 1860–Sec. 302/149–Conviction–Altered by High Court u/s. 304 Pt.-II–Justification–Deceased was taken forcibly in a vehicle–He was forced to lie down on the ground and, thereafter, the injuries were inflicted–Fracture in rib nos. 6 to 10 of the right side–Right lung was ruptured–Windpipe and foodpipe were ruptured–Cause of death was excessive bleeding due to injuries on vital parts–It cannot be said that the injuries were accidental or unintentional–Prosecution established the three ingredients forming the part of thirdly of Sec. 300–High Court adopted the easy method of accepting the only contention canvassed that the offence was culpable homicide not amounting the murder–Accused are liable to be convicted u/s. 302/149.
