Code of Criminal Procedure, 1973–Sec. 299–Penal Code, 1860–Secs. 498A & 304-B–Present accused was declared absconder and, thereafter, other two co-accused were convicted–She surrendered before the trial Court after a long span of 16 years–She was well aware of proceedings against the other co-accused–Witness P was produced before trial Court but he was aged of 80 years and it was found that he was not capable of hearing and speaking–Held, conditions prescribed in Sec. 299 stand fulfilled and his deposition in previous trial can be read in proceedings against the present accused–Ordered accordingly.
