Penal Code, 1860–Secs. 337 & 338–Cognizance for the offence–Justification–Victim sustained the inuries due to shock of electric current emitting from the wire lying on the road–Name of any person responsible for the mischief has not been mentioned in the FIR or the statements of witnesses–Trial Court issued the process against the officers who were posted in Electricity Department at the relevant time–It is not comprehensible as to who were the persons responsible for the dereliction of the duties or recklessness and negligence–Specific plea that the electric lines were installed and maintained by RRVPN whereas the cognizance has been taken against the officers of AVVNL–Impugned order is liable to be quashed and set aside with the liberty of passing the fresh order.
