Code of Criminal Procedure, 1973–Sec. 439–Official Secrets Act, 1923–Secs. 3 & 3/9–Penal Code, 1860–Sec. 120B–Bail–Entitlement–Petitioner is facing trial before the Magistrate Court and in any case, he cannot be awarded the sentence of more than seven years–He is in custody since 08.06.2020 –He has already undergone half of the maximum sentence which can be awarded in case of conviction–Only 2 witnesses out of total 37 witnesses have been examined–It would be appropriate to enlarge the petitioner on bail subject to certain conditions.
