Rajasthan Panchayati Raj Act, 1994–Sec. 38(4)–Suspension of sarpanch on the ground of involvement in the offence u/ss. 399 & 402 IPC–Charge has not been framed–Criminal proceedings are not in regard to the offence of moral turpitude–Further, the order was not in consonance with the provisions of Sec. 38(4) as no inquiry was initiated–Impugned order deserves to be quashed and set aside.
