Code of Civil Procedure, 1908–Order 6, Rule 17–High Court allowed the special civil application and set aside the order by which the trial Court had denied to grant the permission for amendment in plaint–Justification–Application for amendment in plaint was filed at the belated stage when the suit was fixed for final arguments–Further, the suit could still be decided even without there being any necessity of amendment in plaint–Impugned order passed by High Court is liable to be set aside.
