Code of Civil Procedure, 1908–Sec. 100(5), proviso–Scope–Proviso recognizes the power to hear the appeal on any other substantial question of law which was not initially framed u/s. 100(4)–However, this power can be exercised only after assigning the reason for framing such additional question of law at the time of hearing the appeal.
