Hindu Marriage Act, 1955–Sec. 13(1)(ib)–Desertion–Elements which are to be proved in order to constitute the matrimonial offence of desertion:-
(1) factum of a valid marriage,
(2) the intention to desert i.e. animus,
(3) the factum of separation i.e. deserend;
(4) animus deserendi without just and reasonable cause,
(5) desertion for a continuous period of two years immediately preceding the date of presentation of petition.
