Code of Civil Procedure, 1908–Secs. 47, 151 & 148–Specific Relief Act, 1963–Sec. 28–Execution Court allowed the application of decree-holder for extending the time period in depositing the balance amount of sale consideration and dismissed the objection filed by the judgment-debtor–Instant revisions–Decree was passed on 26.09.1994 and no time was fixed within which the balance amount was to be paid by the plaintiff–Defendants filed the appeal which was dismissed on 15.03.2016–Plaintiff-deposited the amount in the Court below on 16.05.1995 through a challan–Judgment passed by the trial Court merged with the judgment passed by the appellate Court–The time period for deposit the time would commence from the date of judgment and decree passed by the appellate Court–Execution Court rightly extended the time.
