Penal Code, 1860–Secs. 323, 384, 406, 423, 467, 468, 420 & 120-B–FIR for the offence–Sustainability–Respondent was the trustee, and he was removed from the post–He filed the civil suit for declaration–He admitted the fact of pendency of civil suit and factum of passing the adverse orders on the interlocutory applications in the said civil suit–He concealed the pendency of the civil suit to cover up the civil nature of the dispute–No allegation in the complaint that the appellants had intentionally put the respondent in fear of injury either to himself or another or by putting him under such fear of injury, dishonestly induced him to deliver any property or valuable security–Dispute is essentially of civil nature–Attempt of respondent to use the criminal proceedings as a weapon of harassment against the appellants–FIR is liable to be quashed.
