Carriers Act, 1865–Sec. 10–Suit under–Dismissal of–Two generator sets of the plaintiff were to be transported from Calcutta to Sriganganagar–After the delivery, plaintiff no. 2 examined them and found that the damage was caused to them–Notice was required to be issued within a period of six months from the date of knowledge–Conclusion of Trial Court that the notice dated 24.03. 1981 was not proved by the plaintiff that the same was issued and served to the defendants–Except the notice, there is no mention in the plaint about the cor-respondence dated 31.08.1981, AD receipt thereof, letters dated 12.12.1981, 22.09.1981 and 18.11.1981 though the suit was filed in the year 1983–Findings recorded by the Trial Court on the issue no. 4 are just, proper, and correct–Interference declined.
