Code of Civil Procedure, 1908–Order 26, Rule 1–Direction to Commissioner to ascertain the khasra numbers of property–Justification–Earlier, the prayer of same effect had been rejected–Trial Court cannot ask the Commissioner to ascertain the khasra number on the same ground–Further, the Mauka Commissioner cannot be appointed for collecting the evidence–Furthermore, the Commissioner has submitted the report with regard to status of property along with the colour photographs, there is no reason to again refer the matter–Impugned order is liable to be set aside.
