Penal Code, 1860–Sec. 498-A–Scope of continuation of proceedings–Held, if at the stage of framing of charge, necessary ingredients for the offence u/s. 498-A are not made out at all and the trial on the basis of such charge would be an exercise in futility and would amount to the abuse of process of law, then the discharge of accused should be ensured .
