Penal Code, 1860–Secs. 396, 460 & 302–Conviction–Sustainability–Only evidence of recovery of ornaments pursuant to the alleged statements u/s. 27 of Evidence Act–Deceased was not a licenced pawn broker nor was there any register maintained by him which could otherwise have given a clue or lead to reach the persons who had pledged the ornaments–Evidence against the appellant is extremely weak–He is entitled to be acquitted.
