Criminal Trial–Second FIR for the same offence–Allegations levelled in the FIR no. 96/2014, lodged in Punjab are not distinguishable with the present FIRs–Petitioners have already been convicted in that case–Held, the State of Rajasthan should not proceed against the petitioners in the present FIRs–However, the prosecution is free to carry out the investigation against any other person other than the petitioners.
