Code of Civil Procedure, 1908–Sec. 96–Leave to appeal–Scope for granting–In another suit filed by the applicant, the order of status quo has been passed by the appellate Court–By the impugned decree of instant suit, Municipal Board has been directed to execute the sale deed in favour of the plaintiff–If the applicant is not permitted to challenge the decree, his purpose of filing the appeal in another suit would be frustrated and that would amount to two contradictory decrees–Application deserves to be allowed.
