Rajasthan Tenancy Act, 1955–Sec. 183-B–Code of Civil Procedure, 1908–Sec. 10–Scope–Proceedings u/s. 183-B are not a suit and are merely an application inquiry whereof is required to be made in a summary manner–That apart, the provision itself starts with a non-obstantive clause in relation to any provision of the Act–So the provisions of Sec. 10 CPC would not be attracted in such proceedings–Tehsildar was not justified in staying the proceedings u/s. 183-B on the ground of pendency of matter before SDO–Order was rightly set aside.
