Evidence Act, 1872–Sec. 27–Recovery of bag, vehicle and weapon–Reliability–No independent witness of recovery–Blood found on bag was not matched with the blood group of deceased–Further, the fact that it was recovered from forest after seven months of incident, is not believable–Vehicle was recovered u/s. 102 Cr.P.C., however, no evidence available to connect the appellants with this vehicle–Further, the prosecution failed to establish that the recovered weapon was used in offence–Held, recovery is not admissible.
