Penal Code, 1860–Sec. 302–Conviction–Whether can be altered u/s. 304 ?–Incident occurred in two episodes–In first one, the victim gave a stab injury to appellant during the case of quarrel–In the second episode, appellant stealthily entered into the house with a wooden stick and took a country grinding stone and hit on the head of deceased twice–He also gave the beating to the witness on her cheek and body–FIR was lodged immediately–It cannot be said that the injury was caused in sudden provocation–Case does not fall under any exception of Sec. 300–Interference declined.
