Contract Act, 1872–Sec. 74–Public auction–Breach of contract–Four conditions were not complied by the bidder–However, these conditions were not the part of contract and were added unilaterally–State was having no right to insist upon bidder to accept these conditions–Further, the contract could have also not been cancelled on the ground of non-compliance of these conditions–No breach of contract–Right of forfeiture of money was not available to State.
