Penal Code, 1860–Sec. 149–Applicability of Section–Five persons were named in FIR, however, police filed the charge sheet only against two persons, and three other persons were added by allowing the application u/s. 319 –Trial was ordered to be separated because all these three accused remained absconded–Section 149 would be applicable in such a situation.
