Code of Civil Procedure, 1908–Order 22, Rules 3 & 4–Deceased was plaintiff in one suit and defendant in other suit which were consolidated–Application under Order, 22 Rule 3 filed by R was allowed on the ground of testamentary succession–Whereas the application u/s. Order 22, Rule 4 filed by petitioner was dismissed–Appreciation of–Impleadment is merely to continue the proceedings in absence of deceased and it cannot be held determinative and conclusive of right as to succession–Interference declined.
