Penal Code, 1860–Secs. 302/34–Conviction–Sustainable against whom ?–Name of appellant V was not disclosed in FIR whereas V was known to complainant–Complainant admitted in cross-examination that he knew the appellant V for about 8-10 years and V was working with him in a gas agency–He also admitted that he did not disclose to description of the person who was accompanied with accused S–This fact renders the case of prosecution doubtful as regard to involvement of appellant V–He is entitled to be acquitted.
