Penal Code, 1860–Sec. 302/34–Conviction–Sustainability–15 to 20 persons had joined the complainant party but none of them thought to go police station and chose to go to an Advocate which was staying at a distance of 15 Kms.–FIR was not lodged in the proper police station–Date and time of dispatch of FIR were not mentioned–It seems anti-time–Appellants were impleaded subsequently–No independent witness was joined in investigation whereas more than hundred persons were present–Held, appellants are entitled for getting the benefit of the doubt.
