Penal Code, 1860–Secs. 364 & 342–Scope of the constitution of offence–When a person is compelled or induced by force to go from any place and such abduction takes place in order to ultimately eliminate him the offence would be made out u/s. 364–In the instant case, the deceased was given severe injuries by wrongful restraining–When he lost consciousness, he was shifted to a different place–Offence u/ss. 342 & 364 r/w. 34 was made out.
