Penal Code, 1830–Sec. 149–Applicability–PW 3 clearly stated that six assailants i.e. four appellants launched the assault on the victims–Investigation qua two other accused is still pending because they are absconding–Participation of more than five persons in the assault–Plea of non-applicability of Sec. 149 is liable to be turned down.
