Code of Criminal Procedure, 1973–Sec. 362–Prevention of Corruption Act, 1988–Sec. 19–On an earlier occasions, the trial Court had deferred taking cognizance under the impression that the Sanction u/s. 19 of PC Act was required–Decision was not a final order disposing of the case and it was much less conclusive–On the subsequent date, investigation officer brought to the notice of trial Court that the sanction was not required, and trial Court took cognizance–By this, trial Court was not reviewing it’s earlier order–Held, High Court wrongly set aside the order of taking cognizance.
