Urban Land (Ceiling & Regulation) Repeal Act, 1999–Sec. 3(2)–Scope–If any transfer is effected after the land had vested surplus and with the State Govt. u/s. 10(5) of the Act, the transfer would be void ab initio and transferee would not be entitled to challenge the alleged inaction on part of State Govt. or the Competent Authority is not taking possession in compliance with the provisions of Sec. 10(5)–View of High Court that the possession was not taken–View can not be held correct as the Tehsildar had taken the possession on 20.8.1994.
