Code of Civil Procedure, 1908–Order 7, Rule 14(3)–Earlier, the application for taking certain documents on record was dismissed on the grounds that neither they are original nor their copies were produced alongwith plaint, therefore, the documents cannot be taken on record without permission under Order 7, Rule 14(3)–Subsequently petitioner filed the application under Order 7, Rule 14(3) and respondent filed its reply–Held, trial Court ought to have decided the application on the grounds of merits–Impugned order set aside and matter remanded back for deciding afresh.
