Code of Civil Procedure, 1908–Order 37–Trial Court granted the leave to defend–Ground of petitioner-plaintiff that reasons were not assigned for doing so–Normal rule would be not to refuse leave to defend and exception would be refusal of permission to defend–Held, reasons were not required to be assigned–Moreover, the impugned order reveals that the Court below has looked into the circumstances disclosed in the plaint as well as in application for leave as a reason for allowing the prayer.
