Penal Code, 1860–Secs. 465, 467, 471, 420 & 406–General Rules (Civil), 1986–Rule 181–Evidence Act, 1872–Sec. 45–Direction for examination of cheques in dispute by FSL after taking the specimen signatures–Both the cheques which are the subject-matter to the complaint are also the subject matter of two other litigations–Complainant never disputed his signatures on the cheques in question–He filed the application for examination of cheques by concealing the material facts–Further, before issuance of record, the order of High Court was to be taken in view of provisions of Rule 181–Cheque holder was having every right to fill up the blanks of cheque–Held, the impugned order cannot be sustained and deserves to be quashed with imposing of cost.
