Code of Civil Procedure,1908–Order 8, Rule 9–Transfer of Property Act, 1882–Secs. 105 & 106–Plaintiff was allowed for filing replication–Appreciation of–Suit for eviction–View of Court below that the statements pleaded by defendant in written statement were required to be replied by the plaintiff–It was also observed by Court below that the facts sought to be pleaded by the plaintiff by way of replication were related to previous prceedings–Granting of permission is not for introduction of new plea or to alter the original cause of application–Held, permission was rightly granted.
