Penal Code, 1860–Sec. 304-B–Establishment of offence–Prosecution should prove the following preliminary facts by a preponderance of probability:-
(i) that the death of a woman has been caused in abnormal circumstances by her having been burned or having been a bodily injury,
(ii) within seven years of marriage,
(iii) and that she was subjected to cruelty or harassment by her husband or any relative of her husband,
(iv) in connection with any demand for dowry, and
(v) that the cruelty or harassment meted out to her was soon before her death.
