Penal Code, 1860–Secs. 302/34 & 447–Arms Act, 1959–Sec. 4/25–Conviction–Proper Section–Only PW 7 and PW 8 are reliable witnesses–Their statements were recorded after five days–Some previous monetory dispute–Both the appellants assaulted the deceased and inflicted one knife injury each to him–Appellant B aimed the knife injury on the abdomen of deceased, who swayed to avoid the blow, which lended on his left thig–Injury was sufficient in ordinary course of nature to cause death–Appellants were definitely having knowledge coupled with common intention that giving such blows to
the deceased by knives could lead to his death–Conviction deserves to be altered u/s. 304 Pt. I /34.
